While we strive for consistency, please note that our product range may expand or change over time as we add new products or adjust our offerings based on customer demand and availability from suppliers. We shall try to ensure that the information provided on Our Platforms in relation to the Product description and prices is accurate and valid, however, errors may occur. In the event such an error affects your order, we shall notify you.
Product Availability
Although we constantly check the accuracy of our stock on Our Platforms, an error may occur. If we discover any stock error with any Product you ordered, we shall inform you as soon as possible.

Order and Acceptance
Your placement of an order on Our Platforms represents an offer to purchase the particular Product from us. When you order more than one item, it represents a set of offers for each Product separately.
Upon receipt of your purchase order, we shall send you a confirmation email confirming if your offer to purchase has been accepted. Please pay attention when placing your purchase order, as you shall not be able to modify your purchase order subsequent to receiving the confirmation email. The confirmation email will outline the details of your purchase order and is deemed as an acceptance of your offer, and thus, giving rise to a sale / purchase agreement between us on these Terms of Use.

In any of the above situations, We shall inform you that the order has not been accepted, and shall refund any amounts that you may have paid in relation to the order.
The price of the Products will be as quoted on Our Platforms from time to time, except in cases of obvious error. Product prices include VAT at the prevailing rate. The price quoted on Our Platforms for Products excludes delivery charges which are quoted separately on Our Platforms.
Product prices and delivery charges (if applicable) are subject to change at any time, but changes will not affect orders in respect of which We have already sent you a confirmation email.
You shall make the payment at the time of placing your order on Our Platforms, which shall include the price of the Product(s) and any other services requested by you. Any payment on Our Platforms shall be made through a Visa or MasterCard credit/debit card in UAE Dirhams (AED).
All credit / debit card payments are subject to authorisation/ validation by the issuing bank. If the issuing bank refuses to authorise the payment, We shall cancel your order or contact you to check if an alternative method of payment can be arranged. We shall not be responsible if this results in a delay of the delivery of your Product(s) or Product(s) becoming out of stock.
Further, when you submit your payment details/information (including but not limited to, credit/debit card number, full name, billing address, home address, account number and expiration date of the credit/debit card) on Our Platforms to place an order, your payment details shall be provided directly to our payment provider via a secured connection. We shall not store or collect your payment information, and shall not be held responsible and/or liable for any losses suffered by you, whether directly or indirectly, as a result of you sharing your payment details/information on or through our Platforms. Any and all losses arising due to you sharing your payment information with our payment provider shall solely be the responsibility and liability of the payment provider.
The Products’ prices are set in UAE Dirhams (AED).
We also provide our customers with the option of paying for orders with Cash on Pickup (“COP”) or by bank card at our Boutique. The payment shall be accepted in UAE Dirhams, as displayed during checkout.

By placing an order through our Platforms, you acknowledge and agree that full liability for the Products rests with the manufacturer and that, to the extent permitted by the applicable laws, we carry no product liability for those items save as described in the Returns section in Our Cancellation, Exchange and Return Policy.
Risk of loss and title for the Products ordered passes to you upon full payment and acceptance of Product(s).
Our Products come with a manufacturer’s warranty. Details of the manufacturer’s warranty can be found with the documentation that comes with your product. Registration may be required to benefit from the warranty or any extended warranty.

You shall abide by all copyright notices, trademark rules, information, and restrictions contained in any BORK Material accessed through the Platforms, and shall not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purposes whatsoever any BORK Material or third party submissions or other proprietary rights not owned by you: (i) without the express prior written consent of the respective owners, and to reproduce, duplicate, copy or re-sell any part of the Platforms in contravention of the provisions of these Terms of Use. In any case you shall be solely liable for any breach of law or/and infringe of intellectual property rights caused by unauthorized use of BORK Materials.

We do Our best to make your experience with us smooth and satisfying, provided to the extent our existing technologies and conditions can achieve, and we are eager to ensure the continuity and security of our services. However, due to legal, technical and other risks that we cannot foresee, prevent and are out of our control, along with force majeure events (including but not limited to, natural disasters such as floods, earthquakes, large-scale plague and other epidemics, and storms, and social events such as strikes, wars, turmoil, and government actions), such as password stealing ware (Trojan Horse), viruses, hackers’ attacks, defected equipment, general system instability, discontinuance of network connections on your side, actions of the authorities etc. service suspension, data loss, and other losses may occur for which we, to the fullest extent permitted by law, fully waive our liability.

BORK is not responsible for any information posted on the websites of third parties to which you may navigate through the Platform. If you use such links, you will leave our Platforms. Such links should not be interpreted as approval by Us of those linked websites or information you may obtain from them. We have no control over the linked sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. If any provision, or part of a provision, of these Terms of Use is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Terms of Use, and the legality, validity or enforceability of the remainder of the provisions of these Terms of Use shall not be affected, unless otherwise required by operation of applicable law.

يجب عليك إجراء الدفع وقت وضع طلبك على منصاتنا، والذي سيتضمن سعر المنتج (المنتجات) وأي خدمات أخرى طلبتها. سيتم إجراء أي دفع على منصاتنا من خلال بطاقة ائتمان/خصم فيزا أو ماستركارد بدرهم إماراتي (AED).
تخضع جميع عمليات الدفع ببطاقة الائتمان/الخصم للترخيص/التحقق من البنك المصدر. إذا رفض البنك المصدر ترخيص الدفع، سنقوم بإلغاء طلبك أو الاتصال بك للتحقق مما إذا كان يمكن ترتيب طريقة دفع بديلة. لن نكون مسؤولين إذا أدى هذا إلى تأخير في توصيل منتجك (منتجاتك) أو نفاد المنتج (المنتجات) من المخزون.
علاوة على ذلك، عندما تقدم تفاصيل/معلومات الدفع الخاصة بك (بما في ذلك على سبيل المثال لا الحصر رقم بطاقة الائتمان/الخصم، الاسم الكامل، عنوان وفوترة، العنوان المنزلي، رقم الحساب وتاريخ انتهاء صلاحية بطاقة الائتمان/الخصم) على منصاتنا لوضع طلب، سيتم تقديم تفاصيل/معلومات الدفع الخاصة بك مباشرة إلى مزود الدفع الخاص بنا عبر اتصال مؤمن. لن نخزن أو نجمع معلومات الدفع الخاصة بك، ولن نتحمل المسؤولية و/أو المسؤولية عن أي خسائر تتكبدها، سواء بشكل مباشر أو غير مباشر، نتيجة لمشاركتك لتفاصيل/معلومات الدفع الخاصة بك على أو من خلال منصاتنا. جميع الخسائر الناجمة عن مشاركتك لمعلومات الدفع الخاصة بك مع مزود الدفع الخاص بنا ستكون وحدها مسؤولية ومسؤولية مزود الدفع.

من خلال وضع طلب عبر منصاتنا، فإنك تقر وتوافق على أن المسؤولية الكاملة عن المنتجات تقع على عاتق الشركة المصنعة، وأننا لا نتحمل أي مسؤولية عن منتج في الحدود المسموح بها بموجب القوانين المطبقة، إلا كما هو موضح في قسم السياسة الإرجاع ضمن سياسة الإلغاء والاستبدال والإرجاع الخاصة بنا.
تنتقل مخاطر الخسارة والملكية للمنتجات المطلوبة إليك عند السداد الكامل وقبول المنتج (المنتجات).
تأتي منتجاتنا مع ضمان من الشركة المصنعة. يمكن العثور على تفاصيل ضمان الشركة المصنعة في المستندات المرفقة مع المنتج الخاص بك. قد يلزم التسجيل لاستفادة من الضمان أو أي ضمان موسع.
قد يتم تقييد أو تعليق استخدامك والوصول إلى المنصة والخدمات، وإلغاء حسابك كليًا أو جزئيًا، دون إخطار مسبق إليك في الحالات التالية:
أ) انتهاك متعمد لهذه "شروط الاستخدام" و/أو أي من القوانين أو اللوائح المحلية أو الوطنية أو الدولية المطبقة؛
ب) وجود دين مستحق للرسوم المستحقة الدفع لاستخدام أو الوصول إلى المنتجات والخدمات التكميلية الخاضعة للرسوم في الوقت المناسب وبالكامل (إن وجدت)؛
ج) في حالة إلزامنا بإنهاء خدماتنا ومنصتنا كليًا أو جزئيًا بسبب متطلبات قانونية أو متطلبات إلزامية للسلطات المختصة؛ أو
د) الاستخدام غير المصرح به أو الاستخدام الخاطئ المتعمد للمنصة والخدمات.
تشكل قناعة بورك المعقولة الأساس الصالح للإجراءات المذكورة أعلاه.
يُمنع عليك بشكل صارم استخدام المنصات للأغراض التالية، والتي لا تعد قائمة شاملة:
قد نقوم أيضًا بإجراء تغييرات على الخدمات أو تعليقها أو إنهائها (i) إذا كان ذلك ضروريًا بسبب القانون المطبق أو الإجراءات القانونية أو النزاعات القضائية و/أو الطلبات من السلطات العامة والحكومية، (ii) في سياق التطوير المستمر للمنصات، (iii) لأسباب تقنية معقولة، (iv) بسبب المتطلبات التشغيلية المعقولة (بما في ذلك الاندماج أو التقسيم أو الاستحواذ أو نقل الأصول)، أو (v) إذا كان التعليق أو الإنهاء أو التغيير لصالح المستخدمين.
على الرغم من أن خدماتنا ومنصاتنا يمكن استخدامها أو الوصول إليها في جميع أنحاء العالم، إلا أن وظائف المنصة والخدمات القابلة للوصول في بعض البلدان/المناطق قد تختلف أو تكون محدودة، مقارنة بتلك المتوفرة في بلدان/مناطق أخرى. أنت تفهم وتوافق على أن بعض أو جميع ميزات المنصة والخدمات قد لا تكون متاحة أو مناسبة للاستخدام في بعض البلدان/المناطق. نتنازل عن جميع المسؤوليات عن أي ضرر أو خسارة ناتجة عن استخدامك للمنصات والخدمات إذا اخترت استخدام المنصة والخدمات، حتى لو كنت تلبي انحرافات عن الاستخدام العادي وأنت المسؤول الوحيد عن الامتثال للقوانين المحلية المطبقة.
تم تصميم منصاتنا وإنشاؤها لأغراض توفير المعلومات والخدمات لاستخدامك الشخصي. يمكنك تنزيل أو طباعة المواد المتاحة لك عبر المنصات، أو تنزيل التطبيق على جهاز الجوال الخاص بك، لاستخدامك الخاص غير التجاري أو المنزلي فقط، شريطة الحفاظ على إشعارات الملكية الفكرية، وبخاصة إشعارات الملكية الفكرية مثل حقوق الطبع والنشر © والعلامة التجارية ™، سليمة ولا يتم استغلالها أو تعديلها أو حذفها أو تغييرها.
ما لم ينص على خلاف ذلك، يجب أن تفترض أن جميع الملكية الفكرية المحتواة رقميًا والمقدمة والمعروضة والمفصح عنها من خلال المنصات (مثل الصور والصور الفوتوغرافية، بما في ذلك أي شخص ممثل في الصور الفوتوغرافية، والرسومات والرموز والنصوص ومقاطع الفيديو والموسيقى والمواد المكتوبة وغيرها) ("مواد بورك ") محمية بتشريعات مثل حقوق النشر والتصاميم والعلامات التجارية وبموجب أحكام المعاهدات الدولية والقوانين الوطنية في جميع أنحاء العالم. يجب عليك الالتزام بجميع إشعارات حقوق النشر وقواعد العلامات التجارية والمعلومات والقيود الواردة في أي مواد بورك يتم الوصول إليها من خلال المنصات، ولا يجوز لك استخدام أو نسخ أو إعادة إنتاج أو تعديل أو ترجمة أو نشر أو بث أو نقل أو توزيع أو أداء أو تحميل أو عرض أو ترخيص أو بيع أو استغلال لأي أغراض كانت أي من مواد بورك أو إرسالات طرف ثالث أو أي حقوق ملكية أخرى لا تملكها: (i) دون الحصول على موافقة كتابية مسبقة صريحة من أصحاب الحقوق المعنيين، وإعادة إنتاج أو نسخ أو إعادة بيع أي جزء من المنصات بما يتعارض مع أحكام هذه "شروط الاستخدام". في أي حال من الأحوال ستكون أنت المسؤول الوحيد عن أي انتهاك للقانون و/أو انتهاك لحقوق الملكية الفكرية الناتج عن الاستخدام غير المصرح به لمواد بورك.
كما توافق على عدم الوصول بدون تصريح أو التدخل أو الإضرار أو تعطيل:
قد نوفر خدمات تفاعلية على المنصات من وقت لآخر.
عندما نوفر أي خدمة تفاعلية، سنوفر لك معلومات واضحة عن نوع الخدمة المقدمة، وما إذا كانت مرشدة، وما هي صيغة الرقابة المستخدمة (بما في ذلك ما إذا كانت بشرية أو تقنية).
عند استخدام أي من خدماتنا التفاعلية، يجب على المستخدمين الحفاظ على تفاعلاتهم ضمن القيود والحدود المذكورة أعلاه، وبما يتماشى مع معايير المحتوى الخاصة بنا كما هو مبين أدناه.

إن وصولك واستخدامك للبرامج والمواد الأخرى على أو من خلال منصاتنا هو على مسؤوليتك الخاصة فقط.

ما لم ينص على خلاف ذلك صراحةً؛ إلى أقصى حد يسمح به القانون، تستثني المنصات والموردين والموفري المحتوى والمعلنين لدينا صراحةً جميع الشروط والضمانات والأحكام الأخرى التي قد تكون ضمنية بموجب القانون أو العرف أو قانون الانصاف؛ ولن تكون مسؤولة عن أي أضرار مهما كانت، بما في ذلك على سبيل المثال لا الحصر أي أضرار مباشرة أو غير مباشرة أو خاصة أو تبعية أو عقابية أو عرضية، أو أضرار لفقدان الاستخدام أو الأرباح أو البيانات أو غيرها من الأصول غير الملموسة ، أو الضرر بالشهرة أو السمعة، أو تكلفة الحصول على بضائع وخدمات بديلة، والناشئة عن أو المتعلقة باستخدام أو عدم القدرة على استخدام أو أداء أو أعطال المنصات أو المواقع المرتبطة وأي مواد بورك أو مواد أخرى منشورة عليها، بغض النظر عما إذا كانت تلك الأضرار متوقعة أم نشأت بموجب العقد أو الخطأ أو الإنصاف أو الاسترداد أو بموجب القانون العام أو خلاف ذلك.

نحن ومزودو خدمات الإنترنت من الأطراف الثالثة، بغرض التحليل غير الشخصي لاهتمامات العملاء والعملاء المحتملين، نجمع بيانات إحصائية عن عرض المنصة. البيانات التي يتم جمعها في هذه الحالة مجهولة المصدر وعامة وبالتالي لا تسمح بتحديد المستخدم المحدد الذي تشير إليه.
دون المساس بحقوقنا الأخرى بموجب هذه الشروط والأحكام، إذا انتهكت هذه الشروط والأحكام، سواء بشكل مباشر أو غير مباشر، فقد نتخذ الإجراء الذي نراه مناسبًا للتعامل مع الانتهاك، بما في ذلك على سبيل المثال لا الحصر، تعليق وصولك إلى موقعنا الإلكتروني، ومنعك من الوصول إلى المنصة، وحظر جهازك باستخدام عنوان IP الخاص بك من الوصول إلى المنصة، والاتصال بمزود خدمة الإنترنت الخاص بك لطلب حظر وصولك إلى المنصة و/أو رفع دعوى قضائية ضدك.
يرجى العلم أن هذه الشروط والأحكام تخضع وتفسر وفقًا للقوانين الاتحادية السارية في دولة الإمارات العربية المتحدة. ويوافق الطرفان على الاختصاص القضائي الحصري ومكان الإقامة للمحاكم الكائنة في دبي في أي إجراء لإنفاذ (أو ما يتعلق بخلاف ذلك) هذه الشروط والأحكام.
إذا وجد أي حكم، أو جزء من حكم، من هذه الشروط والأحكام أنه غير قانوني أو باطل أو غير قابل للإنفاذ، فسيُعتبر أن هذا الحكم أو الجزء منه لا يشكل جزءًا من هذه الشروط والأحكام، ولن تتأثر شرعية أو صلاحية أو إنفاذ بقية أحكام هذه الشروط والأحكام، ما لم يكن ذلك مطلوبًا بخلاف ذلك بموجب عملية القانون المعمول به.
تشكل هذه الشروط والأحكام الاتفاقية الكاملة بينك وبيننا فيما يتعلق باستخدام المنصات، وتحل محل وتلغي جميع الاتفاقيات السابقة والاتفاقيات المقترحة والترتيبات والتعهدات أو العقود الجانبية من أي طبيعة، سواء كانت شفهية أو خطية، فيما يتعلق بهذا الموضوع.
لا يُعتبر تنازل بورك عن انتهاك لأي حكم من هذه الشروط والأحكام على أنه تنازل عن أي انتهاك آخر أو لاحق.
